The Office of the Inspector General (OIG) maintains a database of all currently “excluded individuals and entities” (these are practitioners or companies that cannot bill Medicare because of some enforcement action) called the List of Excluded Individuals/Entities (LEIE). Anyone who hires an individual or entity on the LEIE may be subject to civil monetary penalties (CMPs). To avoid CMP liability, health care entities should routinely check the list to ensure that new hires and current employees are not on it. I will say that a different way: If you hire/employ a practitioner who is excluded from Medicare, you can be subject to monetary penalties. It is the job of the employer to check the list.
